The Facts: The Events as They Unfolded

On Wednesday, two federal prosecutors in Washington—Carlos Valdivia and Samuel White—were informed they would be placed on leave after requesting a 27-month prison sentence for Taylor Taranto, a man who participated in the January 6, 2021 Capitol attack and was later granted clemency by former President Donald Trump. Taranto had been found guilty at a bench trial of showing up outside former President Barack Obama’s Washington home in June 2023 while armed with two firearms and ammunition. The prosecutors noted in their sentencing papers that Taranto had been among the “mob of rioters” on January 6 and had promoted conspiracy theories concerning the attack. Taranto was originally charged with trespassing and disorderly conduct for his role in the Capitol riot, but those charges were dismissed as part of the blanket clemency Trump granted to nearly 1,600 people accused of participating in the attack. This action represents the latest in a series of retaliatory measures by the Trump administration against prosecutors in the U.S. attorney’s office in Washington who worked on cases related to January 6, a campaign that has previously included dismissals and demotions of justice department officials.

Opinion: A Chilling Attack on Justice and Democracy

This reprehensible act of political retribution against career prosecutors represents nothing less than a direct assault on the independence of our justice system and the rule of law itself. The message being sent is chillingly clear: if you dare to seek appropriate punishment for those who participated in an attack on our democracy, you will face professional consequences. This administration’s pattern of protecting those who violently assaulted the Capitol while punishing the prosecutors who seek to hold them accountable is fundamentally incompatible with democratic principles and the constitutional order. The blanket clemency granted to January 6 participants was already a staggering blow to justice, but now we witness the punishment of those simply doing their jobs to protect public safety. When a man shows up armed outside a former president’s home after participating in an insurrection, society has every right to expect serious consequences—not the protection of the very administration that should be upholding the law. This political interference in the justice system erodes public trust, undermines institutional integrity, and sets a dangerous precedent that threatens the very foundations of our republic. Those who attack our institutions must be held accountable, not protected, and those who uphold the law must be supported, not punished.
